Our Wedding Cakes Terms and Conditions:

It is vitally important that you take the time to read the terms and conditions listed below.

Our standard terms and conditions of trading as Our Wedding Cakes @ The Fruitcake Factory:

These terms and conditions are the basis of a contract between Our Wedding Cakes @ The Fruitcake Factory and you (known from herein as our client).

These terms and conditions, the client order and the confirmation of your order booking are to be the whole agreement between Our Wedding Cakes @ The Fruitcake Factory and you, our client as you purchase a cake.

It is your responsibility to check your full written quotation for your cake order, of which you will receive a copy and we will keep a copy on file to work from.

By paying your deposit you are confirming that you agree to these terms and conditions with Our Wedding Cakes @ The Fruitcake Factory

Our Goods for Sale:

We always offer a cake tasting and design experience at our registered studio on Meopham Green in Kent. This is free of charge. However, all designs created remain the copyright of Our Wedding Cakes and it is expected that we create them in their entirety. This will give you an insight into us, our business and how we create our stunning cakes. We will not create in its entirety someone else’s copyright material without full written permission from the owner. Please do not ask us.

Your wedding cake quotation remains valid for a period of 7 days from the day that you receive your cake tasting and design experience or from a telephone request to hold the date until the cake tasting can be arranged, subject to availability. The price will be quoted for the shape, size and depth of the cake in inches that is currently discussed. The cost may change for a larger cake, deeper cake, different shaped cake, more tiers etc. This would have to be discussed further. Our standard cake bases are baked and layered to a depth of 5” approximately 13cm. A deeper cake is available and would be priced accordingly.

A contract is made when the client’s deposit is received and receipted by Our Wedding Cakes @ The Fruitcake Factory. This is legally binding.

The Cake, the Price and the Payment:

The price of the cake will be given in your written quotation. The delivery cost will be included on your written quotation.  An invoice will be issued 8 weeks before your delivery/collection date. The balance must be settled and cleared into The Fruitcake Factory business account no later than 6 weeks before your function. It will be the client’s responsibility to ensure this is completed. We recommend a bank transfer. But cash and cheque are acceptable. A receipt will be issued by Our Wedding Cakes.

If payment is not received the order will be deemed as cancelled.

Alterations, postponements and cancellations:

Any alterations to the original booking must be requested in writing or by email up until 8 weeks before the function date. This will be confirmed by Our Wedding Cakes in email form as received. No confirmation means that we have not received the request. It is the client’s responsibility to contact us again. Alterations cannot be made after this deadline as raw material orders and work rotas are arranged.

Should a cancellation be made by the client, the following cost will incur:

6 months before the function date the £100 deposit

8 weeks before the function date the full payment

Postponement Our Wedding Cakes are happy to postpone your booking subject to the new date being available. Please note that there is a possibility of a price increase of which we will notify you in writing.

In the unlikely event that Our Wedding Cakes need to cancel your order, any money paid by the client will be completely refunded. Our Wedding Cakes @ The Fruitcake Factory reserve the right to cancel an order if forces beyond our control occur. Such as Forces of nature, hostilities, pandemics, riots, non availability of raw materials and subjects beyond our control. Our Wedding Cakes shall not be liable for a breach of contract through this.

Our wedding Cakes liability will be the issue of a credit note to cover the full cost or a full refund in the manor that the deposit or full account was paid. This shall be limited to the value of the goods only.

Cake Stand and Bridal Knife:

The cost of the cake does not include the hire of the stand and knife. A CASH security deposit of £100 is required along with the final payment. The stand must be returned to the studio between the hours of 9.00 am and 1.00pm within 3 days of the function. Upon return and condition the security deposit will be refunded.

Our Celebration Cakes:

We guarantee that our cakes collected or delivered, conform to the description and cost set in our original quotation. Be of a good quality and confirm with the current food hygiene regulations in the UK. We cannot be held responsible if the client is dissatisfied with the interpretation of the design if it follows the original design and quotation that the client agreed on booking. It is the client’s responsibility to ensure that the working drawing and written quotation details meet their exacting requirements. Our Wedding Cakes @ The Fruitcake Factory will accept NO consequent liability.

We cannot guarantee a defect that has arisen due to wilful damage, incorrect storage, neglect, accidental damage arising from the client or a third party once the cake has left our hands.

Environmental and Health and Safety issues.

Our bakers and decorators and trading premises are registered with a five star rating at Gravesham Borough Council. We carry Public Liability Insurance. We also have all relevant training certificates in the handling of food, including honours in the Royal Institute of Public Health and Hygiene certificates. Having been leaders and lecturers in the industry for 24 years.

Allergens:

Our Cakes are made in an environment which stores food allergies, such as nuts, gluten, eggs, milk etc.

Although you may order a ‘nut free’ cake and we will make every effort to ensure that the allergies are stored in bins in cupboards. WE ARE NOT AN ALLERGY FREE ENVIRONMENT.

All our cakes are coated with white chocolate ganache to give the latest sharp edge trend. With the exception of naked and semi naked cakes. This is before sugar paste or a final sugar type coating is used.

Our aim is to recreate your colour scheme required, but this is limited to the food grade colour mixes that are available to us. We do our utmost to accommodate.

The Use of Fresh Flowers in contact with food.

We do not promote the use of fresh flowers with our cakes. Most fresh flowers are toxic or have come into contact with pesticides. However, fresh flowers must be placed by the client or by the client’s florist in agreement with the client, should these be required. To agree the sizes and shapes of cakes that we supply, it is advisable, that the client advises the florist to contact us directly for a consultation.

Non Edible Materials in food use:

Your cake may contain food grade plastic rods to aid with construction. These must be removed before the cake is cut and consumed. We will make your venue aware and supply a written copy of this to them.

Most of our flowers are made from sugar, however, many are wired to create floral enhancement and must be treated as non edible.

You may have ordered non edible craft jewels. Remove from the cake and store away for safety before cutting and consuming your cake.

Our character figures are created for fun and although we can match hair colour, eye colour glasses, dimples etc. They are never meant to be realistic life sculptures.

Storage:

All our cakes, whether collected or delivered are supplied from our bakery as fresh as is practical. We do not use additives other than food colours and these are as natural as possible. We do not add preservatives. Therefore your cake should be stored cool and dry.

NOT IN A REFRIGERATOR. They have a maximum shelf life of 3 days when cut. They will freeze successfully, if wrapped tightly in cling film and stored in a sealed plastic box. To thaw, remove from the freezer. DO NOT OPEN THE BOX FOR !2 HOURS. Consume immediately. Do not re-freeze or store for 3 days!

Delivery and Collection:

Delivery or collection is arranged when the deposit of the cake and the booking is made. The time will be confirmed when the balance of the cake is paid for. We can only offer a guide time for delivery as this can be affected by traffic issues, weather, etc. Our Wedding cakes will do our utmost to ensure that the date and time agreed are achieved. However, we cannot accept liability for delays beyond our control. Once the cake is set up and displayed at the client’s venue, we are no longer responsible for the cake.

We will always contact the client’s venue to arrange a mutually convenient time for Our Wedding Cakes to arrive. If we are requested to set up the cake, it will be photographed on completion and if possible we will obtain a signature from the venue to confirm that the cake is received in good condition. Once delivered we cannot accept any liability for damage received after this delivery.

Complaints:

Please note that we can only deal with the person that placed the order as they will have firsthand knowledge of the issues under review:

Complaints are very rare. This is because we work individually with our clients from the first contact through to the final delivery or collection. We do take any issue extremely seriously. Any issues under review must be brought to our attention within   48 hours of delivery/collection to give us an opportunity to assess the situation.

Both Our Wedding Cakes and the Client agree that the situation will be dealt with amicably and without the issue of posting negative comments on any social media , online forums or website.

Any complaints regarding the quality of the inside content of the celebration cake must be backed with the keeping of the remainder of the cake or the tier. That we can assess the nature of the complaint. This must be returned to Our Wedding Cakes with 48 hours of delivery/collection to allow us assess the issues fairly.

Our General Terms and Conditions:

All our designs are created with our clients, and remain the property of the client and Our Wedding Cakes.

Our Wedding cakes reserve the right to use these designs and images of the client’s cake for the use of our advertising and promotion. This includes on social media, our website, brochures, displays, promotional meetings and competitions.

This agreement and your booking deposit confirm that you are in agreement with this statement.

The headings used in these terms and agreements are nothing more than to draw your attention to specific areas of discussion and note and nothing more.
